These Terms are an agreement between you and Nierro ("we", "us") about your use of Zoom Zoom Zoo (the "Game"). By using the Game you agree to them. If you do not agree, do not use the Game.
1. Who can play
You must be at least 13 years old (or older where your local law sets a higher age for online services) to use online and social features. Players under 13 may only use the single-player parts. If you are below the age of majority where you live, you confirm a parent or guardian has agreed to these Terms for you.
2. Your account
Your profile is identified by a Player ID. Keep your backup code and password safe: you are responsible for what happens through your profile. Do not share, sell or trade your profile. Tell us at zoomzoosupport@gmail.com if you think someone else is using it.
3. Licence to play
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the Game. You may not copy, modify, reverse-engineer or resell the Game, use cheats, bots, exploits or modified apps, or interfere with the servers or other players.
4. Virtual items and Paw Coins
Paw Coins and the items, looks, animals and banners you unlock or buy are a licence to use them in the Game, not property. They have no cash value, cannot be sold or transferred outside the Game, and are not refundable except as the law or the app store's rules require. We may change prices, rewards and what items do. If your profile is closed for breaking these Terms, you may lose your items. Purchases are made through Google Play or the Apple App Store and are subject to their terms and refund rules.
5. Levels and other content you create
"Your Content" means levels you build, level names, your display name, and anything else you submit or publish in the Game.
- You keep ownership of Your Content.
- You give us a worldwide, free, non-exclusive, transferable, sub-licensable licence to host, store, copy, display, distribute, play, adapt, modify, edit, fix, translate, reformat, re-upload, re-publish and create derivative works from Your Content, in the Game and in its promotion (for example screenshots, trailers and featured lists), for as long as the Game or the content exists. This licence is irrevocable for content that other players have already played, rated or saved, and for backups and copies we need to keep to run the Game, except where the law says otherwise.
- We may, at our sole discretion and without notice, remove, hide, disable, rename, edit, re-balance or re-upload any level or other content, take it from one profile and republish it under another label or our own account, restore it, or limit who can see it, for example to fix a bug, protect players, follow the law, answer a report or keep the Game fair. We have no duty to host or keep any content.
- You promise that you made Your Content or have the right to use it, that it does not break anyone's rights or the law, and that it follows these Terms and the Community Guidelines.
- To the extent the law allows, you waive any moral rights in Your Content against us and our licensees, and you will not be paid for our use of it.
- Content from other players is theirs. You may play it in the Game but not copy it out of the Game.
6. Rules
You must follow our Community Guidelines. In particular do not post or do anything that is illegal, hateful, harassing, sexual, violent, deceptive, or that shares someone's private information; and do not cheat, spam, impersonate others or attempt to harm the Game. We may warn, hide content, suspend or permanently close profiles that break the rules. You can appeal by writing to zoomzoosupport@gmail.com.
7. Reporting and takedowns
You can report any level from inside the Game and block its creator. If you believe content breaks your copyright, send zoomzoosupport@gmail.com a message that says: what the work is, where it appears in the Game (level code and name), your contact details, that you believe in good faith the use is not allowed, and that your statement is accurate (and, if you are not the owner, that you are authorised to act). We may remove content and close the profiles of repeat infringers.
8. Third-party services
The Game may use third-party services (app stores, hosting, crash reporting). Their terms apply to your use of them.
9. Changes to the Game and the Terms
We may update, add, remove or end any part of the Game, including online features, at any time. We may change these Terms; if the change is important we will tell you in the Game. Using the Game after a change means you accept it.
10. Ending
You can stop using the Game at any time and delete your data from Settings > Delete My Data. We may suspend or end your access if you break these Terms or the law.
11. Disclaimer
The Game is provided "as is" and "as available". We do not promise it will always work, be error-free or keep your data safe. Some places do not allow some of these exclusions, so they may not apply to you.
12. Limit of liability
As far as the law allows, we are not liable for indirect, incidental, special or consequential losses, lost data or lost profits, and our total liability for any claim about the Game is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these Terms limits liability that cannot be limited by law (for example for death or personal injury caused by negligence, or for fraud).
13. Law and disputes
These Terms are governed by the laws of California, USA, without regard to conflict-of-law rules. Courts of that place have jurisdiction, except that if you are a consumer you keep any right you have to use the courts and consumer laws of the place where you live.
